In the last thirty years volunteering, has gradually evolved from being in a modest position, to being recognized as a key player in the development of different countries. This has led citizens to participate in the design and implementation of actions aimed at obtaining the interest of the population, well beyond purely altruistic attitudes. This position, characterized by isolated and sporadic events, lacks the effective and coordinated actions that a regulation guiding the scope of collective works would have.<\/p>\n

These actions have been promoted to an international level through UN\u2019s resolutions of the General Assembly, some of which are worth mentioning:<\/p>\n

– Resolution 40\/212 of December 17, 1985, where December 5th was declared as the International Volunteer Day for Economic and Social Development;<\/p>\n

– Resolution 52\/17 of November 20,1997 in which the year 2001 was proclaimed\u00a0 as the International Year of Volunteers.<\/p>\n

Both initiatives are intended to make visible the work of international volunteering and to encourage the discussion of its importance, prompting many countries to join the global commitment to recognize and celebrate volunteering as a way of achieving the Millennium Development Goals declared by the United Nations. These objectives aim to reduce poverty, hunger, disease, illiteracy, environmental degradation and discrimination against women.<\/p>\n

The Republic of Panama has not been immune to this global movement, therefore, organizations of various kinds and several national companies, among them the\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0Morgan & Morgan Group, have identified volunteering as an effective method of achieving an equitable society.<\/p>\n

Panama has taken a more active role in the promotion and recognition of volunteering, hosting in 2008 the XX World Volunteer Conference of the International Association of Volunteer Effort (IAVE, for its acronym in English), and participating in 2010 in the Latin American Conference on Volunteering, held in Bogot\u00e1, Colombia. The result of these participations was the need for Panama to have a law regulating voluntary work, associated with international practices.<\/p>\n

Subsequently, in collaboration with IAVE \u2013 Panama, civil society partners, and the private sector, the Morgan & Morgan Group, represented by a group of lawyers committed to pro bono projects, conducted a comparative study of the main laws of volunteering in the world, which aim was the development of a draft bill regulating volunteering in Panama and adjusted to modern trends, without ignoring the realities of the country.<\/p>\n

The purpose of this bill is to promote, perform, encourage and develop volunteerism in both the public and private sectors in the Republic of Panama, through joint coordination during a Volunteer Forum.<\/p>\n

The preliminary draft sets as the objectives of volunteering to: contribute with their effort, skills and capabilities in order to provide quality of life for people and communities promoting their development with dignity and justice and, at the same time, maintaining values such as respect, solidarity, peace and freedom; raise public awareness to practice activities that promote social welfare, solidarity and cooperation for the benefit of people and communities in situations of disadvantage or vulnerability; and strengthen the initiatives carried out by public and private organizations who intend to promote sustainable human development in Panama.<\/p>\n

The draft also establishes the principles of volunteering commitments and the rights of volunteers, the responsibilities of voluntary organizations, and the minimum incentives and recognitions that the law must acknowledge in regards to volunteer work.<\/p>\n

Currently, the bill is under evaluation and being reviewed by various organizations that have volunteers in Panama, so that the final document is the product of a consensus of stakeholders. After the deadline, it will be presented as a citizens’ initiative to the Board of Deputies of Panama for its debate and subsequently for its approval.<\/p>\n

Through pro-bono actions, such as counseling, advocacy, drafting and revising the volunteering draft bill in Panama, the Morgan & Morgan Group reiterates its international commitment, acquired in 2001 by signing the Global Compact of the United Nations, as a socially responsible company. We are firm believers that the adoption of this bill and its enactment into law will reorganize volunteerism in Panama, maximizing the collaboration of volunteers towards meeting the Millennium Development Goals.<\/p>\n

\u00a0Nelva\u00a0Marissa\u00a0Ara\u00faz \u00a0Reyes, currently supports CSR consultancies at Morgan & Morgan. She joined the CSR area of Morgan & Morgan in 2007, collaborating with the Eduardo Morgan foundation and later in the coordination of the Community Legal Assistance Foundation (Fundalcom). Before joining Morgan & Morgan, Attorney Ara\u00faz Reyes, worked in legal offices that handled environmental, civil and criminal issues, as well as the Citizens Alliance for Justice, where she gained experience in project development, public policy and legislation analysis. Attorney Ara\u00faz Reyes, received her degree in Law and Political Science at the University of Panama, completed specialized studies in Procedural Law at the Interamerican University of Panama and a master’s degree in Criminal Policy at the National Autonomous University of Mexico where she is currently finishing her JD.<\/p>\n

Fundalcom is the only project of this nature among Panamanian companies that aims to guide, and give legal representation \u2013for free- to low income individuals in processes of family law and domestic violence. The foundation is supported also by lawyers and partners of Morgan & Morgan providing legal assistance through its Pro Bono program.<\/p>\n

En los \u00faltimos treinta a\u00f1os el voluntariado ha ido pasando, progresivamente, \u00a0de una posici\u00f3n poco visible, a ser reconocido como actor clave en el desarrollo de diferentes pa\u00edses, generando que los ciudadanos, participen en el dise\u00f1o y ejecuci\u00f3n de acciones\u00a0 dirigidas a la obtenci\u00f3n del inter\u00e9s general, buscando as\u00ed superar actitudes meramente altruistas, que eran caracterizadas por acciones aisladas y espor\u00e1dicas,\u00a0 sin ser tan eficaces,\u00a0 como lo son las acciones coordinadas y\u00a0 amparadas por una regulaci\u00f3n, que involucre trabajos colectivos.<\/p>\n

Estas acciones han sido fomentadas desde el plano internacional, mediante la ONU, por medio de resoluciones emitidas por la Asamblea General, de las cuales vale la pena destacar:<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 la Resoluci\u00f3n\u00a0 40\/212 del 17 de Diciembre de 1985, mediante la cual se decret\u00f3 el 5 de diciembre como el d\u00eda Internacional del Voluntario, para el Desarrollo Econ\u00f3mico y Social;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 la Resoluci\u00f3n 52\/17 del 20 de noviembre de 1997, mediante la cual se proclam\u00f3 el a\u00f1o 2001 como el A\u00f1o Internacional de los Voluntarios.<\/p>\n

Ambas iniciativas ten\u00edan como objeto visibilizar la labor del voluntariado a nivel internacional y fomentar debates sobre la importancia del voluntariado, lo que gener\u00f3 que muchos pa\u00edses se adhirieran al compromiso mundial de reconocer y exaltar el voluntariado a lo interno de los mismos, como una forma de alcanzar los Objetivos de Desarrollo del Milenio, declarados por la Naciones Unidas y que buscan reducir la pobreza, el hambre, la enfermedad, el analfabetismo, la degradaci\u00f3n del medio ambiente y la discriminaci\u00f3n de las mujeres.<\/p>\n

La Rep\u00fablica de Panam\u00e1 no fue ajena a este movimiento mundial, por tanto, organizaciones de diversa \u00edndole y varias empresas nacionales, dentro de las cuales se encuentra Morgan & Morgan, logran identificar al voluntariado como un eficaz m\u00e9todo\u00a0 para alcanzar el desarrollo equitativo de la sociedad.<\/p>\n

Es as\u00ed como Panam\u00e1 va tomando un rol m\u00e1s activo en la promoci\u00f3n y reconocimiento del voluntariado, siendo sede en el 2008 de la XX Conferencia Mundial de Voluntariado de la Asociaci\u00f3n Internacional de Esfuerzo Voluntario (IAVE, por sus siglas en Ingl\u00e9s); y, en el 2010 participa en la Conferencia Latinoamericana de Voluntariado de IAVE, celebrada en Bogot\u00e1, Colombia. Producto de estas participaciones se ve la necesidad de que en Panam\u00e1 existiese un cuerpo normativo que regulara el trabajo voluntario, aline\u00e1ndolo a las tendencias internacionales.<\/p>\n

Es as\u00ed como en colaboraci\u00f3n con IAVE \u2013 Panam\u00e1 y con aliados de la sociedad civil y del sector privado, Morgan & Morgan, representado por un grupo de abogados, realizaron un estudio comparativo de las principales leyes del voluntariado del mundo, con la finalidad de dise\u00f1ar un anteproyecto de Ley que regulara el voluntariado en Panam\u00e1 y que estuviera ajustado a las tendencias \u00a0modernas, sin desconocer las realidades propias del pa\u00eds.<\/p>\n

El objetivo de este anteproyecto es el de fomentar, efectuar, promover, exhortar y desarrollar el voluntariado tanto en lo p\u00fablico como en lo privado en la Rep\u00fablica de Panam\u00e1, mediante una coordinaci\u00f3n conjunta que se realizar\u00e1 a trav\u00e9s de una Mesa de Concertaci\u00f3n del Voluntariado.<\/p>\n

En el anteproyecto se establecen, como objetivos del voluntariado, el de contribuir con su esfuerzo, habilidades y capacidades, a brindar calidad de vida a las personas o comunidades, propiciando su desarrollo, para que vivan con dignidad y justicia, y fomentando un entorno que permita la vida en com\u00fan manteniendo valores de respeto, solidaridad, paz y libertad; elevar la conciencia ciudadana para que practiquen actividades para el bienestar social, de solidaridad y cooperaci\u00f3n en beneficio de las personas o comunidades en situaciones de desventaja o vulnerabilidad; y, fortalecer la gesti\u00f3n que realizan las organizaciones p\u00fablicas y privadas que tienen como finalidad propiciar el desarrollo humano y sostenible en Panam\u00e1.<\/p>\n

Asimismo se establecen los principios del voluntariado, los compromisos y derechos de los voluntarios, las responsabilidades de las organizaciones voluntarias, los incentivos y los reconocimientos m\u00ednimos que por ley se deben hacer en torno al trabajo voluntario.<\/p>\n

Actualmente, el anteproyecto se encuentra en consulta y revisi\u00f3n de diversas organizaciones que mantienen voluntariados en Panam\u00e1, de modo que el documento final, sea producto de un consenso de los actores involucrados. Una vez terminado el plazo indicado, se presentar\u00e1 como iniciativa ciudadana a la Asamblea de Diputados de Panam\u00e1, para su discusi\u00f3n y si as\u00ed lo aceptan los diputados, para su aprobaci\u00f3n.<\/p>\n

A trav\u00e9s de acciones pro – bono como la asesor\u00eda, fomento, redacci\u00f3n y revisi\u00f3n del anteproyecto de Ley del Voluntariado en Panam\u00e1, Morgan\u00a0 & Morgan, reitera su compromiso internacional, adquirido en el 2001, mediante la firma del Pacto Global de las Naciones Unidas, como empresa socialmente responsable, ya que somos fieles creyentes de que de convertirse en Ley este anteproyecto, se permitir\u00e1 reorganizar el voluntariado en Panam\u00e1, maximizando la colaboraci\u00f3n de los voluntarios en pro del cumplimiento de los objetivos del milenio.<\/p>\n

Nelva Marissa Ara\u00faz Reyes, actualmente apoya con consultor\u00edas de RSE en Morgan & Morgan.\u00a0 Ingres\u00f3 al \u00e1rea de RSE de Morgan & Morgan\u00a0 en el 2007, colaborando con la Fundaci\u00f3n Eduardo Morgan y posteriormente en la coordinaci\u00f3n de la Fundaci\u00f3n de Asistencia Legal Comunitaria. Antes de ingresar a Morgan & Morgan, la Licda. Ara\u00faz Reyes, trabaj\u00f3 en despachos judiciales que manejaban temas ambientales, civiles y penales, as\u00ed como en la Alianza Ciudadana Pro Justicia, en donde gan\u00f3 experiencia en la formulaci\u00f3n de proyectos, pol\u00edticas p\u00fablicas y an\u00e1lisis de las legislaciones. La Licda. Ara\u00faz Reyes, obtuvo su licenciatura en Derecho y Ciencias Pol\u00edticas en la Universidad de Panam\u00e1, culmin\u00f3 estudios de especializaci\u00f3n en Derecho Procesal en la Universidad Interamericana de Panam\u00e1 as\u00ed como una maestr\u00eda en Pol\u00edtica Criminal en la Universidad Nacional Aut\u00f3noma de M\u00e9xico. Y, actualmente se encuentra finalizando sus estudios de doctorado en Derecho en esta \u00faltima universidad.<\/p>\n

Fundalcom es un proyecto \u00fanico en su naturaleza entre firmas de abogados y empresas privadas de Panam\u00e1 que\u00a0 tiene como objetivo ofrecer a personas de escasos recursos econ\u00f3micos de la comunidad paname\u00f1a, asesor\u00eda y representaci\u00f3n legal gratuita, en procesos de derecho de familia y violencia dom\u00e9stica. La Fundaci\u00f3n es apoyada por el trabajo pro bono de socios y abogados de Morgan & Morgan.<\/p>\n
